If the loan shark you are talking about is not a bank or financial institution but an individual then if he/she files a case by bouncing the cheque, it is definitely going to be a jail sentence if the full amount is not paid. Any cheque bounce claimed by an individual will get the defendant behind bars and it is not same as how it for the banks.
Then, what are the consequences a side from getting in jail? And how long? Can we also file a case against the loan shark for handling the passport of my brother? Because that’s the reason why he can’t get the job because he have his passport.
Holding anybody’s passport is illegal let that even be someone’s employer. If you have to file a case for the same against someone, you should possess a valid document or agreement signed which states that the defendant has hold on your passport. A passport is property of ones government even though you paid for
It, thus handing over your passport to someone else for other than immigration or visa purposes is also illegal. Get in touch with an attorney to solve this issue on better terms and your brother needs to get into a mutual settlement with the loan shark if he needs to avoid jail term.

Rent cheques to a Landlord is a kind of security cheque and is not a liability lended to the tenant by Landlord and is considered as livelihood expense. A personal cheque to any friend, relative or unknown individual is considered as repayment of debt to that person and if bounced, will definitely face a jail term if case is filed and if no mutual settlement is agreed. Never compare a heard situation with someone else until details are enquired as it could mislead.

That’s also what I know. That’s the reason why my brother can’t get i job bec.he is keeping his passports. How can he pay his debt if he don’t have a job, also he’s keeping harassing my brother.

Really? Then, if ever if the loan shark bounced the issued cheque of my brother we can just pay the fine.

In June this year...a friend got arrested for a bounced rent cheque...he was taken to Barsha Police Station and given a paper to come for a hearing after 10 days.....on the D day...he was asked can u pay this x amount fine...he said he would...he was let go after paying the fine...the cheque was not written to a bank neither a financial institution....
